A court-based separation
Judicial separation allows a court to make orders concerning property, maintenance, children and pensions while the spouses remain legally married.
Why it may be considered
It may be relevant where divorce conditions are not yet met, urgent orders are needed or agreement is not possible.
It is different from divorce
Judicial separation does not permit remarriage. A later divorce application may still be required.
Advice should cover the full picture
Court proceedings can have long-term financial and family consequences. Obtain advice on evidence, disclosure, interim protection, cost and alternatives.
